The Ontario New Home Warranties Plan Act (ONWP) outlines the warranty coverages that builders are required to provide to the buyers of their homes, and provides for a mechanism to ensure that reasonable complaints are investigated and rectified by builders.
As
a purchaser of a newly constructed home, you have various rights
pursuant to the Warranty Program and, in particular, there are
provisions by which you may compel the completion or repair of
prescribed items of construction.
Coverage
under the Act includes deposit protection, protection against
defects in work and materials, protection against unauthorized
substitutions, and protection against delayed closings or delayed
occupancies without proper notice. For condominiums, warranty
coverage also includes common/shared areas of the building. Legal advice may be necessary where a builder fails to comply with the Plan's requirements or otherwise refuses to complete a required repair. Contact Toronto real estate lawyer Shashi Raina by email or by telephone at (416) 972-1781 for more information on the Ontario New Home Warranty Program or to arrange a consultation, without fee or obligation, to discuss your needs and requirements. |
